These terms and conditions govern the participation in the giveaway, contest, competition or promotional campaign (“Giveaway“) organised by IBPO GROUP BERHAD and/or its affiliated and related companies (“IBPO“, “we” “us” or “our“) from time to time on its official third-party social media pages, such as Instagram and Facebook (collectively “Social Media Sites”). By participating in the Giveaway, the participants agree to these terms and conditions:-

1. ELIGIBILITY

1.1 The Giveaway is open to all Malaysians above the age of 18 and residing in Malaysia.

1.2 Participants to our Giveaway on Social Media Sites must be from a genuine social media account. IBPO reserves the rights to disqualify or reject any entries coming from an account that are (i) non-genuine account; (ii) account name changed after submission of entry(ies); (iii) same owner and/or beneficiary for multiple social media accounts; and (iv) in our sole determination, believes that the account has attempted to undermine the operation of the Giveaway by fraud, cheating, deception or conduct deemed unacceptable to us.

1.3 Employees of IBPO (including its affiliated and related companies) and their immediate family members shall not be eligible to participate in the Giveaway.

1.4 IBPO shall reserve the right to request for evidence of identification documents.

2. GIVEAWAY PERIOD

2.1 Each Giveaway begins and ends on the dates and times as specified on the respective social media post (“Entry Period”). 

2.2 Entries will only be accepted during the Entry Period. All entries received outside the Entry Period will be disqualified.

2.3 IBPO reserves the right to amend, vary, postpone or reschedule the dates and times of the Giveaway or extend the Entry Period at its absolute discretion.

3. GIVEAWAY MECHANISM

3.1 The mechanism of all Giveaways vary, and will be stipulated on its respective terms & conditions on the relevant social media post.

3.2 Participants who enter the Giveaway must follow all stated terms & conditions as specified in the relevant social media post.

4. PRIZE AND WINNERS

4.1 Prize(s) and the number of winners for all Giveaways varies, and will be stipulated on its respective terms & conditions on the relevant social media post.

4.2 The winners’ names will be notified or announced by IBPO through the mode and in such manner as set out in the respective terms & conditions.

4.3 Prize(s) must be claimed in person unless IBPO prescribe another mode of collection. Where we elect to or is requested to post/courier a prize(s) to the winners, no responsibility will be accepted by IBPO for the safe and effective delivery of the prize(s) or damages caused during the delivery process.

4.4 In the event, for any reason whatsoever, any of the winners (i) does not respond to us within the stipulated time period after being notified of his/her win; (ii) is unable to collect the prize(s) within the stipulated time period; (iii) choose not to accept the prize(s) or did not redeem the prize(s) within the stipulated time period; or (iv) has breached any terms and conditions herein, the respective prize(s) shall be forfeited and IBPO shall be entitled to select another winner. IBPO shall not reimburse or compensate the winner for failure to collect the prize(s) within the stipulated time period.

4.5 All prize(s) are given on an “As Is” basis and are not exchangeable for cash, credit, other items or vouchers, in part or in full.

4.6 IBPO makes no warranties or representations whatsoever with respect to the prize(s) (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose) and shall not be responsible nor liable for any problems and/or damage there to or arising there from.

4.7 IBPO reserves the right to substitute any of the prize(s) with items of equivalent value and without prior notice.

5. USE OF PERSONAL DATA

5.1 As participants and/or winners of the Giveaway, a participant may be required to provide his/her personal details to us which details may include (i) full name; (ii) contact number; (iii) home address; (iv) email address; (v) NRIC number; and (vi) date of birth (“Personal Data”) as part of participation process. By participating in the Giveaway, the participant agrees to the collection, use, processing and/or disclosure of the participant’s Personal Data by IBPO in accordance with IBPO’s Privacy Policy at https://www.ibpo.com.my/privacy-policy/ and for the purpose of the Giveaway, including disclosing the Participant’s name to the general public when the Participant become a winner in a Giveaway by publishing the Participant’s name, photographs and other personal information.

6. GENERAL

6.1 By participating in each Giveaway, the participant shall be deemed to have read, understood, accepted and agreed to be bound by these terms and conditions. Any failure to comply will result in the participant and/or winner being disqualified, and any prize(s) won shall be forfeited.

6.2 IBPO reserves the right to at any time, update, change, amend, delete or add to these terms and conditions at its absolute discretion without prior notice. IBPO further reserves the right, without any liability on its part whatsoever, to cancel, terminate, postpone, suspend or in any other way cease a Giveaway at any time at its absolute discretion without prior notice. Such termination or suspension will not give rise to any claim by the participants.

6.3 Pictures of prize(s) shown on the respective social media post are for illustration purposes only and may differ from the actual item.

6.4 If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
